Fishician® respects intellectual property rights and responds to notices that comply with the Digital Millennium Copyright Act (17 U.S.C. § 512).

Filing a copyright infringement notice

If you believe content on Fishician infringes your copyright, send a notice to our designated agent at [email protected] (subject line "DMCA Notice") including all of the following:

Identification of the copyrighted work you claim is infringed;
Identification of the material claimed to be infringing, with enough detail for us to locate it (e.g. a link to the post or a screenshot with the poster's username and date);
Your name, mailing address, telephone number, and email address;
A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law;
A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act for the owner;
Your physical or electronic signature.

What we do

On receipt of a valid notice we will remove or disable access to the identified material promptly, notify the user who posted it, and record the action. Misrepresenting a claim can make you liable for damages under 17 U.S.C. § 512(f).

Counter-notification

If your content was removed and you believe that was a mistake or misidentification, you may send a counter-notice to the same address including: identification of the removed material and its prior location; a statement under penalty of perjury of your good-faith belief the removal was a mistake; your name, address, and phone number; consent to the jurisdiction of the federal district court for your address (or, if outside the U.S., any judicial district where Fishician may be found); and your signature. If the original claimant does not file a court action within 10–14 business days, we may restore the material.

Repeat infringers

Fishician terminates the accounts of users determined to be repeat infringers in appropriate circumstances.
