Terms of Service

Effective date: July 6, 2026 · These terms govern your use of the Fishician® application and websites.

By creating an account or using Fishician®, you agree to these Terms of Service, the Privacy Policy, and the Community Guidelines. If you do not agree, do not use the service.

1. The service

Fishician provides aquarium management tools, reference information, AI-assisted suggestions, community features, and links to third-party retailers. The service is provided on an "as is" and "as available" basis and may change, be interrupted, or be discontinued at any time.

2. Eligibility and accounts

You must be at least 13 years old to create an account.
You are responsible for your account credentials and all activity under your account. Enable two-factor authentication for stronger protection.
Provide accurate information and keep your email current so we can reach you about security or policy matters.

3. Acceptable use

You agree not to: break the law; infringe others' rights; upload malicious code; scrape, overload, or disrupt the service; attempt to access other users' data; circumvent security or rate limits; resell the service; or post content prohibited by the Community Guidelines.

4. Your content

You keep ownership of content you post. You grant Fishician a worldwide, non-exclusive, royalty-free license to host, store, copy, resize, transcode, display, distribute within the service, promote the service with, moderate, back up, and otherwise operate your content. You are responsible for having the rights to anything you upload. We may remove content or restrict accounts that violate these terms, and we respond to copyright notices under our DMCA Policy.

5. Aquarium information disclaimer — not veterinary advice

Fishician provides general aquarium information and AI-assisted suggestions for hobbyist education only. It is not veterinary medicine, and no output creates a veterinarian–client–patient relationship. AI can be wrong. Species data, dosing calculators, compatibility scores, and health analyses are estimates that may not fit your animals, water, or equipment. Always verify dosages against product labels, and consult a qualified aquatic veterinarian or experienced professional for sick, injured, or valuable animals. You remain fully responsible for the welfare of your animals and for decisions you make.

6. Purchases and third-party links

Fishician links to third-party retailers (including Amazon affiliate links — see the Advertising & Affiliate Disclosure). We are not a party to those transactions and are not responsible for third-party sites, prices, availability, or products. Product mentions are informational, not endorsements or guarantees.

7. AI features

AI features are rate-limited and provided for convenience. Outputs may be inaccurate, incomplete, or unsuitable for your situation, and are not professional advice (see Section 5). Do not submit content you lack rights to, or sensitive personal information, to AI features.

8. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FISHICIAN DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DATA WILL NEVER BE LOST — KEEP YOUR OWN RECORDS OF CRITICAL INFORMATION.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FISHICIAN AND ITS OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF ANIMALS, DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

10. Indemnity

You agree to indemnify and hold Fishician harmless from claims arising out of your content, your use of the service, or your violation of these terms or applicable law.

11. Termination

You may delete your account at any time in Settings. We may suspend or terminate accounts that violate these terms, create risk for others, or as required by law. Sections that by their nature should survive (5, 8–10, 12) survive termination.

12. Governing law and disputes

These terms are governed by the laws of the United States and the state of the operator's residence, without regard to conflict-of-law rules. Disputes will be resolved in the courts of that jurisdiction unless applicable consumer law gives you additional rights.

13. Changes

We may update these terms; material changes will be announced in the app. Continued use after changes take effect constitutes acceptance. Contact: [email protected].
